Terms of Service & Privacy Agreement

Welcome to NovaFlow AI Inc. (“NovaFlow”, “we”, “our”, or “us”). By accessing or using the NovaFlow AI Autonomous Cloud platform, software development kits (SDKs), APIs, and related workflow services (collectively, the “Services”), you agree to be bound by these Terms of Service.

1. Enterprise Service Level & SLA Guarantees

NovaFlow commits to a 99.99% monthly uptime availability standard for all Professional and Enterprise tiers. In the event of an unplanned outage exceeding our published SLA threshold, customers are eligible for prorated service credits in accordance with our Enterprise Service Level Addendum.

2. Data Confidentiality & Zero Model Training

Customer data confidentiality is paramount:

• Zero Training Retention: We will never use customer payloads, workflow definitions, proprietary code, or data streams to train public foundation models.
• In-Memory Processing: Transient event data processed by autonomous agents is purged immediately upon task conclusion, except where audit logging is explicitly retained per customer configuration.
• SOC2 Type II: All systems are audited annually by accredited third-party cybersecurity evaluators.

3. Acceptable Use Policy

Customers agree not to utilize NovaFlow autonomous agents for:

• Unauthorized vulnerability scanning or denial-of-service testing against third-party networks.
• Processing classified or illegally acquired personally identifiable information without consent.
• Any automated decision-making that violates global AI safety standards and applicable national legislation.

4. Intellectual Property & Code Ownership

Customers retain 100% intellectual property ownership over all agent configurations, prompts, custom code connectors, transformed datasets, and workflow outcomes created using the Services. NovaFlow retains ownership only over the underlying platform runtime, edge infrastructure, and SDK frameworks.
